Perpetual Exclusivity for a Custom Design

The agreed eco-bag configuration will not be offered to other customers without any time limit. The price is determined individually.

Have you created a custom design specifically for your brand and want to secure its exclusivity without a time limit? Perpetual exclusivity means that Lavasta Factory will not use the agreed product configuration for other customers and will not publish it in its catalogs, on its website, social media, or advertising materials.

What the Exclusivity Covers

Exclusivity applies to the specific product configuration agreed upon before production begins.

When defining the design, the following characteristics are taken into account:

• shape and construction;
• dimensions and proportions;
• material;
• bottom and side construction;
• type and placement of handles;
• pockets, lining, and closures;
• other significant construction elements.

The agreed configuration can be documented in a technical specification, product specification, sketch, or photographs of the finished product.

Other Designs and Modifications

Exclusivity applies to the specific agreed configuration. Other designs and substantially modified versions are not covered by this service.

A change in color, fabric weight, an individual dimension, hardware, or another secondary characteristic does not in itself constitute a new design. If the construction, proportions, material, or functional elements are significantly changed, the product may be considered a different design.

Customer Prints and Brand Identity

Lavasta Factory does not publish or use the customer's logos, trademarks, branded prints, or other brand identity elements without the appropriate permission.

The perpetual exclusivity service applies specifically to the product construction and does not include the transfer of rights to the customer's brand identity.

Patterns and Production Documentation

Patterns, technical documentation, production files, sewing technologies, know-how, and other internal Lavasta Factory documentation are not transferred as part of the exclusivity service.

If you require the patterns or intellectual property rights to the development, these can be transferred separately as part of the “Full Design Buyout” service.

If the Design Was Created Based on a Reference

If the custom design was developed based on photographs, sketches, or other references, perpetual exclusivity applies to the agreed configuration on the part of Lavasta Factory. We will not use it for other customers under the defined exclusivity terms.

The service does not grant the customer rights to constructions or design solutions that existed previously, are used by other manufacturers, or belong to third parties.

Lavasta Factory will not publish or offer the agreed custom design to other customers for the entire duration of the exclusivity. Perpetual exclusivity is available only for individually developed designs. The price is determined individually based on the complexity and commercial potential of the design.

Patterns, technical documentation, and intellectual property rights to the development are not included in the service price.
