Want a product design developed specifically for your brand to remain available exclusively to you for an extended period? Choose 36-month exclusivity and reserve the agreed product configuration exclusively for your brand.

During this period, Lavasta Factory will not use the design for other orders, add it to its catalog, or publish it on its website, social media, or advertising materials.

What the Exclusivity Covers

The service applies to the specific product configuration agreed upon before production begins.

When defining the design, the following characteristics are taken into account:

• product shape and construction features;
• dimensions and proportions;
• selected material;
• bottom and side construction;
• handle construction, type, and placement;
• pockets, lining, and closures;
• other significant product elements.

The agreed configuration can be documented in a technical specification, product specification, sketch, or photographs of the finished product.

Other Designs and Modifications

Exclusivity applies to the specific agreed configuration. Other designs and substantially modified versions are not covered by this service.

A change in color, fabric weight, an individual dimension, hardware, or another secondary characteristic does not in itself constitute a new design. However, if the construction, proportions, material, or functional elements are significantly changed, the product may be considered a different design.

Customer Logo and Other Brand Identity Elements

Lavasta Factory does not publish or use the customer's logos, trademarks, branded prints, or other brand identity materials without the appropriate permission.

The exclusivity service applies specifically to the product construction and does not include the transfer of rights to its design or brand identity.

Patterns and Production Documentation

Patterns, technical documentation, production files, sewing technologies, know-how, and other internal Lavasta Factory documentation are not transferred to the customer as part of the exclusivity service.

If you require the patterns or intellectual property rights to the development, these can be transferred separately as part of the “Full Design Buyout” service.

If the Design Was Created Based on a Reference

A custom design may be developed based on photographs, sketches, or other references. In this case, exclusivity means that Lavasta Factory will not use the agreed configuration or offer it to other customers for 36 months.

The service does not include the transfer of rights to constructions or design solutions that existed previously, are used by other manufacturers, or belong to third parties.

Service price: UAH 19,900

For three years, Lavasta Factory will not publish or offer the agreed custom design to other customers within the defined configuration. Exclusivity is available only for designs individually developed by Lavasta Factory for your brand. The final service price may depend on the complexity and commercial potential of the design.

Patterns, technical documentation, and intellectual property rights to the development are not included in the service price.
