Exclusive Rights to a Custom Design for 24 Months

Have you created a custom product design for your brand and want to keep it exclusively for your own orders? The “Custom Design Exclusivity” service allows you to reserve the agreed configuration exclusively for your brand for 24 months.

During this period, Lavasta Factory will not publish the design in its catalog, on its website, social media, or advertising materials, and will not offer it to other customers.

What Exclusivity Covers

Exclusivity applies to the specific product configuration agreed upon by both parties before production begins.

When defining the design, the following characteristics are taken into account:

• product shape and construction;
• dimensions and proportions;
• material;
• bottom and side construction;
• type and placement of handles;
• pockets, lining, and closures;
• other significant construction elements.

If necessary, the parameters of the agreed design can be documented in a technical specification, product specification, sketch, or photographs of the finished product.

Which Designs Are Not Covered by the Service

Exclusivity applies to the specific agreed configuration and does not extend to other designs or constructions that have undergone substantial modifications.

A change in color, fabric weight, an individual dimension, hardware, or another secondary characteristic does not in itself constitute a new design. However, significant changes to the construction, proportions, material, or functional elements may mean that the product is considered a different design.

Prints and Brand Identity

Lavasta Factory does not publish or use the customer's logos, trademarks, branded prints, or other brand identity elements without the appropriate permission.

This service applies specifically to the exclusivity of the product construction.

Patterns and Production Documentation

Purchasing exclusivity does not include the transfer of patterns, technical documentation, production files, sewing technologies, know-how, or other internal Lavasta Factory documentation to the customer.

If you require the patterns or intellectual property rights to the design, their transfer can be arranged separately as part of the “Full Design Buyout” service.

If the Design Was Developed Based on a Reference

When a custom design is created based on photographs, sketches, or other references, exclusivity means that Lavasta Factory undertakes not to use the agreed configuration during the specified exclusivity period.

However, the service does not transfer to the customer any rights to constructions or design solutions that existed before the development, are used by other manufacturers, or belong to third parties.

During the exclusivity period, Lavasta Factory will not publish or offer the agreed design to other customers. Exclusivity is available only for designs individually developed by Lavasta Factory for your brand. The final service price may depend on the complexity and commercial potential of the design.

Patterns, technical documentation, and intellectual property rights to the design are not included in the service price.
