Exclusive Rights to a Custom Design for 12 Months

Have we developed a custom design for your brand and you want to keep it exclusive? Order the “Custom Design Exclusivity” service for 12 months.

During the agreed period, Lavasta Factory will not publish this design in its catalog, on its website, social media, or advertising materials, and will not offer it to other customers.

What Is Included in the Service

Exclusivity applies to the specific product configuration agreed upon before production begins.

When defining the design, the following characteristics are taken into account:

• shape and construction;
• dimensions and proportions;
• material;
• bottom and side construction;
• type and placement of handles;
• pockets, lining, and closures;
• other significant construction elements.

The agreed configuration may be documented in a technical specification, product specification, sketch, and photographs of the finished product.

What Is Not Included in the Service

Exclusivity applies to the construction of the specific design and does not include the transfer of patterns, technical documentation, production files, sewing technologies, know-how, or other internal Lavasta Factory documentation to the customer.

If you require the patterns or intellectual property rights to the design, these can be arranged separately as part of the “Full Design Buyout” service.

What Changes Do Not Create a New Design

Exclusivity does not apply to other designs or substantially modified versions.

At the same time, a minor change in color, fabric weight, an individual dimension, hardware, or another secondary characteristic does not in itself constitute a new design.

If the Design Was Created Based on Your Reference

If the product was developed based on photographs, sketches, or other references provided by you, exclusivity means that Lavasta Factory will not use the agreed configuration during the term of the service.

Exclusivity does not apply to constructions or design solutions that existed previously, are used by other manufacturers, or belong to third parties.

Prints and Brand Identity

Lavasta Factory does not publish or use the customer's logos, branded prints, trademarks, or other brand identity elements without the appropriate permission.

The “Custom Design Exclusivity” service applies specifically to the construction of the product.

Exclusivity period: 12 months

Service price: UAH 9,900

After purchasing the service, Lavasta Factory will not publish or offer the agreed design to other customers for 12 months. Exclusivity is available only for designs individually developed by Lavasta Factory for your brand. The final service price may depend on the complexity and commercial potential of the design.

Patterns, technical documentation, and intellectual property rights to the design are not included in this service.
